FRESNO, Calif. (KSEE/KGPE) – The Department of Justice announced that a 61-year-old Porterville man has pleaded guilty to three counts of introducing counterfeit branded drugs into interstate commerce.
According to officials, Fu Tiu was the president and CEO of Golden Sunrise Pharmaceutical Co. and Golden Sunrise Nutraceutical Co., Ltd. (collectively “Golden Sunrise”). That's what it means. According to court documents, on March 30, 2020, Tiu began selling a set of herbal mixtures he called the “Emergency D Virus Treatment Plan” to treat COVID-19. The treatment consisted of a box containing various vials of Golden Sunrise medicines, including a product called “Immunstem,” and an “Emergency D Virus Treatment Plan” information sheet. Officials said Tiu mailed the products to various medical practitioners, government officials and other individuals in California and abroad.
The drug's labeling, including the information sheet that accompanied the drug, was false and misleading, stating that ImmunSet and other Golden Sunrise products were not intended to “treat and correct the course of the viral outbreak in China and other countries.” have their own qualifications.'' on court documents.
Officials said Tiu falsely claimed the product was the first dietary supplement in the United States to be approved by the U.S. Food and Drug Administration as a treatment for the coronavirus. The drug is not FDA-approved, and Golden Sunrise products have never been approved by the FDA for any purpose, officials said.
Tieu is scheduled to be sentenced on June 12, and faces up to a year in prison and a $100,000 fine on each of the three charges.
